The legal landscape of vaping is nuanced in Canada, with different provinces and territories establishing their own regulations. This guide shares information about vaping restrictions in restaurants and cafés in Canada. Always refer to the most recent local laws before vaping in a public place.

What are the vaping laws in Canada?

In Canada, government regulations apply to the sale and use of vaping devices. These include age restrictions, limits on nicotine concentration, packaging and marketing guidelines, and restrictions on where you can vape in public.

Is vaping allowed in restaurants?

In Canada, provincial and territorial governments are responsible for restricting smoking and vaping in all workplaces and public places not federally regulated - such as restaurants1.

 

Under the Tobacco and Vapour Products Control Act and Regulation, owners, managers or lessees, are responsible for ensuring that their public and work places comply with the requirements for creating a tobacco and vapour free environment2.

 

In Ontario, you cannot smoke or vape on a patio of any bar or restaurant, including the public areas within 9 metres of the patio4.

Are there any consequences if someone is vaping in a restaurant?

Individuals who vape in prohibited restaurants may face legal consequences. Violations of smoke and vapour free legislation could result in a fine for the owner, manager, lessee and/or person smoking or vaping2.

 

Each province has its own approach to enforcing vaping restrictions, so penalties can vary by location. Always check the laws in your local province.

How are propylene glycol (PG) to vegetable glycerin (VG) ratios shown?

In most provinces and territories, vaping is banned in indoor public places, which includes cafés3. In some provinces, vaping is also not permitted within a specified perimeter of the establishment. Further restrictions on places where smoking, vaping and cannabis use are prohibited include a: • 9 metre perimeter around restaurant or bar patios.4
