Is it illegal to vape and drive in Canada?

The legal status of vaping and driving is nuanced in Canada. There is no nationwide ban on vaping while driving. If vaping becomes distracting, results in obstruction of the driver’s view, or is combined with other illegal driving behaviour, the driver could be guilty of careless driving or driving without reasonable consideration for others1.

Is it illegal to vape with kids in the car?

In some Canadian provinces, it is illegal to vape with children in the car.

 

To protect children from the harmful health effects caused by exposure to second-hand tobacco smoke and vapour in motor vehicles, it is against the law to smoke tobacco or vape in a motor vehicle if there is someone less than 16 years old in the vehicle2.

 

Anyone convicted of smoking tobacco or vaping in a motor vehicle while a person under 16 years of age is present can face a maximum fine of $2503.
