The rules and regulations around where you can use vape devices in Canada can be confusing. Different laws apply depending on where you are in the country, so it’s important to understand the rules where you are before vaping.

 

This guide will break down Canada’s vaping laws, including how old you need to be to vape and where you can and can’t vape in each province.

What are the vaping laws in Canada?

Canada has laws for labelling, packaging, selling and promoting vaping products. They aim to protect public health and prevent underage vaping. Let's dive a little deeper into the vaping laws in Canada below.

How old do you need to be to buy vapes in Canada?

In Canada, it’s illegal to sell vaping products to anyone under the age of 18, and in some provinces you must be 19 or 21 to buy vaping products.

Where can you vape in Canada?

There are no federal regulations about where you can vape in Canada, but individual provinces and territories, and in certain instances, some municipalities, have their own vaping regulations. Keep reading to learn more about the laws in each province.

Where can’t you vape in Canada?

Many provincial regulations and city bylaws ban vaping in enclosed public places, such as bars, clubs, restaurants, offices, and shops, or on public transport, near doorways and air intakes, or in outdoor spaces, such as playgrounds and school grounds.

 

It’s always best to check the regulations in the province you’re in. You might need to find a designated outdoor area before using your vape.

What is the nicotine strength limit in Canada?

The Nicotine Concentration in Vaping Products Regulations (NCVPR) rule that nicotine e-liquids can have a maximum nicotine strength of 20mg/mL (1.8% (w/w)).

Canadian vape packaging, labelling and promotions regulations

Canada has specific rules for the packaging and labelling of vaping products which can be found in the Vaping Products Labelling and Packaging Regulations (VPLPR). These rules include:

  • Vape products that contain nicotine must display a health warning.
  • Vape products that contain nicotine must display a nicotine concentration statement in milligrams per millilitre. It should be preceded by “Nicotine — ” and followed by the unit of measure “mg/mL”.
  • Vape packaging must contain the common name of each vaping substance it contains. Ingredients that are used solely for flavouring must be listed as “flavour” in English and “arôme” in French.
  • Vaping products that have or contain vape liquid over 0.1mg of nicotine must be sold in child-resistant containers.

 

The Vaping Products Promotions Regulations (VPPR) also stipulates specific rules for the promotion of vaping products. A few of these rules are highlighted below:

  • All advertising promotion for vaping products must convey an appropriate health warning.
  • Vape products must not be promoted to appeal to youth. This includes not using flavour descriptors that might appeal to young people.
  • Lifestyle advertising for vaping products is prohibited. This means that promoting vaping products through testimonials, endorsements, or sponsorship is not allowed.

Vaping rules and regulations are a combination of federal and provincial/territorial laws, so vaping laws in New Brunswick may differ from those in Nova Scotia. Some municipalities have their own rules.

The legal vaping age in Quebec is 18. Vaping in public places, such as restaurants, bars, and workplaces, and near doorways and air intakes, is prohibited. Vaping is also forbidden in public vehicles and vehicles where children under 16 are present. The sale of all flavoured vaping products other than tobacco is prohibited.

 

What are vaping laws in British Columbia?

The legal vaping age in British Columbia is 19. Vaping is prohibited in public buildings and workplaces, as well as near doorways or air intakes. The sale of flavoured vaping products is restricted to vape stores. The sale of e-liquids that contain only flavours (and no nicotine or cannabis) is banned.

 

What are vaping laws in Alberta?

The legal vaping age in Alberta is 18. There is currently no restriction on the sale of e-liquid flavours in Alberta.

 

What are vaping laws in Manitoba?

The legal vaping age in Manitoba is 18. Vaping in enclosed public places, such as restaurants, bars, and workplaces, is forbidden. There is currently no restriction on the sale of e-liquid flavours in Manitoba.

 

What are vaping laws in Saskatchewan?

The legal vaping age in Saskatchewan is 19. Vaping in enclosed public places, on school grounds, and near doorways and windows is forbidden. The sale of flavoured vaping products other than tobacco, menthol and mint is restricted to vape stores.

 

What are vaping laws in Nova Scotia?

The legal vaping age in Nova Scotia is 19. The Smoke-Free Places Act prohibits vaping in enclosed public places, such as bars, restaurants, and workplaces, and in certain outdoor public spaces, such as playgrounds and school grounds. Vaping is also forbidden in cars with children under 19 present. The sale of flavoured vaping products is banned.

 

What are vaping laws in New Brunswick?

The legal vaping age in New Brunswick is 19. The Smoke-Free Places Act prohibits vaping in enclosed public places, such as bars, restaurants, and workplaces, and in certain outdoor spaces, such as sports areas and provincial parks. The sale of flavoured vaping products other than tobacco is banned.

 

What are vaping laws in Newfoundland and Labrador?

The legal vaping age in Newfoundland and Labrador is 19. Vaping is prohibited in all indoor public places, such as restaurants and workplaces. Most municipalities also forbid vaping in outdoor sports spaces, including playgrounds.

 

What are vaping laws in Prince Edward Island?

The legal vaping age in Prince Edward Island is 21. Vaping in indoor public places and workplaces and in vehicles with children under 19 is prohibited. The sale of flavoured vaping products other than tobacco is prohibited.

The legal vaping age in the Northwest Territories is 19. Vaping is prohibited in public places and certain outdoor spaces, such as playgrounds and sporting fields, and near doorways and air intakes. The sale of all vape flavours other than tobacco is prohibited.

The legal vaping age in Yukon is 19. Vaping is prohibited in many public places, including bars, restaurants, and workplaces, as well as near doorways and air intakes. There is currently no restriction on the sale of e-liquid flavours in Yukon.

The legal vaping age in Nunavut is 19. Vaping is prohibited in public places, such as bars, restaurants, and workplaces, near doorways and air intakes and in many outdoor spaces, such as parks. The sale of flavoured vaping products is prohibited.
